Given the engineering, site-specific customization, and specialized procurement involved in our projects, our cancellation and refund terms differ from standard product policies. Please read this policy carefully before placing an order or making any payment.

📋 Our cancellation policy is designed to be fair and transparent for all parties

1. Introduction

EnergyBae Private Limited is committed to delivering high-quality solar, wind, EV charging, and clean energy solutions. We understand circumstances may arise where cancellation or refunds are needed. This policy outlines the conditions, timelines, and procedures applicable to such requests.

📌 By placing an order, accepting a quotation, making a payment, or engaging our services, you confirm you have read, understood, and agreed to this policy.

2. Nature of Our Projects

Many of our products and services involve significant customization and coordination that begins well before physical installation. When an order is confirmed, we typically initiate:

Engineering design and site-specific customization
Procurement of specialized or imported equipment
Manufacturing commitments with vendors and suppliers
Logistics and transportation arrangements
Installation and project planning
Regulatory, utility, and net metering coordination
Financing and insurance coordination

3. Non-Refundable Booking Amount

⚠️ At order confirmation, a non-refundable booking amount of 1% of total Project Cost or ₹5,000 — whichever is higher — is required. This is non-refundable under all circumstances including cancellation, financing rejection, or change of mind.

This covers preliminary consultations, site visits, initial engineering reviews, resource allocation, customer onboarding, and planning activities initiated immediately upon order confirmation.

4. Cancellation Before Project Commencement

Advance payments (above the booking amount) may be considered for refund only if both conditions are met:

Cancellation request received within 5 calendar days from order confirmation, and
No substantial procurement, engineering, design, or permitting activities have been initiated.

Deductions from any approved refund include: non-refundable booking amount, banking/gateway charges, and any third-party costs already incurred. All requests must be emailed to freeenergy@energybae.in.

5. Cancellation After Design Approval

⚠️ Minimum non-refundable: 5% of total Project Cost or ₹10,000 — whichever is higher.

Design approval is deemed to have occurred if you've provided written/electronic confirmation of any design deliverable, accepted revised designs, or made payments due at or after design approval.

6. Cancellation After Procurement

⚠️ Between 20% and 50% of total Project Cost may become non-refundable, depending on procurement stage, vendor commitments, manufacturing stage, import status, and supplier cancellation charges.

7. Cancellation After Installation Commencement

⚠️ 50% of total Project Cost becomes non-refundable as loss of business opportunity once installation, civil works, wiring, equipment placement, or any physical execution has commenced.

Additional costs for specialized equipment deployment, contractor engagement, mobilization, and third-party obligations may also be recovered.

8. Customized Products

The following are generally non-returnable and non-refundable:

Custom-engineered and custom-manufactured systems
Project-specific designs and special-order equipment
Imported equipment procured specifically for a customer
Customized mounting structures, electrical panels, control and monitoring systems

✅ This does not restrict rights in respect of genuine manufacturing defects or valid warranty claims.

9. Return of Physical Products

Returns may be accepted where a product is defective on delivery, materially damaged in transit, or does not match the order. Customer must:

Notify EnergyBae within 48 hours of delivery
Provide photos/videos as evidence
Not use, alter, or install the product pending review
Return products unused, in original packaging with all accessories

10. Refunds

Refunds are available only in circumstances expressly provided for in this policy and are subject to all applicable deductions and non-refundable amounts as outlined above.

11. Damaged or Defective Products

Inspect all products promptly upon delivery. Report any visible damage, shortage, defect, or discrepancy within 48 hours of delivery with supporting evidence. Upon a valid claim, EnergyBae may arrange inspection, repair, replacement, refund, or other appropriate remedy.

12. Digital Services & Reports

⚠️ Professional services, digital deliverables, and intellectual work product are non-refundable once delivered — including feasibility studies, wind speed assessments, engineering reports, energy studies, financial analyses, and software licenses.

13. Financing-Related Refunds

EnergyBae facilitates financing but does not control lender decisions. Rejection of a financing application does not automatically entitle a customer to a refund. Any refund will be assessed based on project stage, services performed, and costs incurred under this policy.

14. Government Subsidies & Incentives

Rejection, delay, suspension, reduction, or withdrawal of any government subsidy, incentive, net metering approval, or regulatory benefit does not entitle a customer to cancel a project or claim a refund from EnergyBae.

15. Refund Processing Period

✅ Where a refund is approved, EnergyBae endeavours to process it within 30 to 60 days from approval date, after verification and settlement of applicable obligations.

Dispute resolution: Amicable negotiation (30 days) → Arbitration under the Arbitration and Conciliation Act, 1996. Seat: Pune, Maharashtra. Exclusive jurisdiction: Courts at Pune.
